First Steps
What to do after an accident in Lakeland
What you do in the first hours and days can make or break your claim. Here’s a simple checklist.
Get safe & call 911
Move out of traffic if you can and report the crash. A police report creates an official record.
See a doctor
Get checked even if you feel okay. Some injuries surface days later, and gaps in care hurt your claim.
Document everything
Photograph vehicles, the scene and injuries. Collect names, insurance info and witness contacts.
Don’t give a recorded statement
The other driver’s insurer may call quickly. You are not required to give them a recorded statement.
Keep your records
Save medical bills, the crash report, repair estimates and any time missed from work.
Talk to an attorney first
Before accepting any settlement, get a free case review. Early offers are often far below fair value.
Know Your Deadlines
Florida injury claim deadlines & fault rules
| Type of claim (Florida) | Deadline to file |
|---|---|
| Most negligence injury claims (car, truck, slip & fall) | 2 years |
| Wrongful death | 2 years |
| Medical malpractice | 2 years* |
| Claims against a government entity | Notice rules apply |
*Medical malpractice runs 2 years from discovery, up to a 4-year outer limit in most cases. Deadlines shown reflect Florida Statute § 95.11 as amended by HB 837 for claims accruing on or after March 24, 2023. Other claim types and exceptions exist — confirm your specific deadline with an attorney.
The clock is shorter than it used to be
For accidents on or after March 24, 2023, Florida cut the deadline for most injury lawsuits from four years to two years. Florida also follows modified comparative negligence: you can still recover if you were partly at fault, but not if you were found more than 50% responsible. Talking to a lawyer early protects your right to file.
